1. Acceptance of Terms
By accessing, browsing, or utilizing the services provided by Waterford (the "Company"), you hereby acknowledge that you have read, understood, and agree to be bound by the following terms and conditions (the "Terms of Service"). These Terms constitute a legally binding agreement between you and the Company. Your continued use of the Service signifies your irrevocable acceptance of these Terms.
2. Description of Service
The Company provides a sophisticated platform for luxury real estate development and related advisory services. We reserve the right, at our sole and absolute discretion, to modify, suspend, or discontinue any aspect of the Service, including but not limited to features, databases, or content, at any time without prior notice or liability to you.
3. User Obligations and Conduct
You covenant and agree to use the Service only for lawful purposes and in strict accordance with these Terms. You are expressly prohibited from: (a) violating any applicable local, state, national, or international laws or regulations; (b) infringing upon the intellectual property, privacy, or publicity rights of the Company or any third party; (c) engaging in any conduct that restricts, inhibits, or disrupts any other user's use or enjoyment of the Service; or (d) attempting to gain unauthorized access to any part of the Service or its related systems.
4. Intellectual Property Rights
All content, features, and functionality integrated within the Service—including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software—are the exclusive property of the Company, its affiliates, or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Company, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content.
6. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the substantive laws of El Salvador, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the competent courts located in San Salvador, El Salvador. You hereby consent to the personal jurisdiction of such courts.
